Physical Description
Collation
The manuscript consists of a binion, 35 quaternions, a quinion and one endleaf. The first quire is a binion formed by ff. [i]-[ii], 1; it is unclear whether the first leaf of the quire is the left pastedown or is not present. In the second quire, the second leaf is not present, without affecting the text. The last leaf of quire 37 is not present without affecting the text.
- Quire 14-1 ff. [i]-1
- Quire 28-1 ff. 2-8(αʹ)
- Quires 3-368 ff. 9-280(βʹ-λεʹ)
- Quire 3710-1 ff. 281-289(λϛʹ)
- 1 paper endleaf ff. [iii]-[iii]
Condition
Layout
ff. 2r-259r A single column of 32 lines. 245 × 130 mm.
ff. 259v-288v A single column of 34-35 lines. ca. 260-270 × 140 mm.
Hand(s)
ff. 2r-289v Hand A: the text has been written by Nikolaos Tourrianos (1535/40-c.1610) , (Νικόλαος Τουρριανός, RGK I, 319. See also RGK II, 438; RGK III, 520) in a minuscule script with "baroque" features; passim vertical strokes are significantly extended in the lower margin, with decorative scrollworks (see e.g. f. 265r).
The scribe in this manuscript differentiates the cited text from the commentary by using a larger script.
The text, including titles and initials, is written in grey/black ink.
The scribe wrote also additions to the text and scholia in the margins.
Hand B: a western European hand (16th/17th c.) added annotations in Latin and in Greek to the index (ff. 2r-12r; mostly they are Latin translations of the topics dealt with in the chapters) and passim annotations and corrections to the text (see e.g. ff. 40r, 54r, 54v). The writing, an informal minuscule, is regular in size, slightly slanting to the right.
Hand C: a later hand added passim annotations and corrections to the text in light brown ink, frequently introducing them by the abbreviated form of γράφε/γράφεται (see e.g. f. 173r) and by ἄρα (see e.g. f. 196v). The script is an informal minuscule, maybe by a western European hand, slanting to the right, irregular, traced with nervous movements.
Decoration
On ff. 2r and 12v there are two small pylai in black ink with a vegetal motif of vine scrolls.
Several friezes in black ink are present throughout the manuscipt. There are friezes with a vegetal motif of vine volute (see e.g. f. 3v), very simple linear friezes with vine leaves (see e.g. f. 4v), friezes with palmette motif (see e.g. f. 5v), friezes with clover motif (see e.g. ff. 8r, 11v, 185v, 281v).
Initials in ekthesis in black ink are decorated with a vegetal motif with scrollworks, and clover and vine motifs see e.g. ff. 12v, 48r, 53v.
Minor initials written in black ink see e.g. ff. 2r-12r.
Clovers and crosses in black ink are traced passim at the end of texts (see e.g. 12r, 258r, 281r.
Additions
Hand B wrote an annotation on the manuscript's contents on f. 1v, ‘Synopsis basilicorum’.
On f. 246r, where the Synopsis Basilicorum ends, Tourrianos wrote in the right margin an annotation saying that the codex is a copy of a manuscript owned by Diego Hurtado de Mendoza, copied at the request of Eduardo Caldera.
On f. 1r there is a note of value in Latin and Spanish (see Provenance).
At f. 289v a later hand wrote under the colophon the date in Arabic numerals, ‘1564’. Another hand wrote it with pencil.
Binding
Western binding, parchment over couched-laminate boards. Rebacked, spine covered in leather, tooled in gold with title ‘Ius civile graecorum M.S.’; leather label on spine with a part of the shelfmark (‘5 11’).
360 × 259 × 82 mm.
On the left board Thomas Tanner (1674-1737) wrote the number (and signature) which the codex has in his handwritten list of the manuscripts of John Moore. Therefore the binding, in any case, cannot be dated later than 1714.
On the upper part of the fore-edge is written the number ‘5’, which probably corresponds with the number written in the upper margin of f. 2r, being maybe an ancient signature of the manuscript.
In fair condition, with some scratches and worm holes on the right board.
Accompanying Material
Between the leaves there is a small piece of western paper, [173a]. 102 × 100 mm. .
It contains a text in modern Greek, written in black ink by a late hand (not before 17th c.), a message adressed by a certain Georgios to a certain Konstantinos.
History
The manuscript was written by the Greek scribe Nikolaos Tourrianos in Salamanca in 1564.
It was copied from MS El Escorial, Real Biblioteca, R.II.11 (see Easterling 1961, p. 259; de Andres 1969, p. 26; Burgmann-Fögen-Schminck-Simon 1995, p. 59), owned by Diego Hurtado de Mendoza (1503-1575) , following a request by the Portuguese humanist Eduardo Caldera (16th-17th c.) ; this is stated in a marginal note by Nikolaos Tourrianos on f. 246r, where the Synopsis Basilicorum ends: ‘Τὸ ἶσον τῆς ἑξηκονταβίβλου τῆς τοῦ λαμπροτάτου Διέγου Μενδοκίου, τῷ τοῦ Δουάρδου Καλδέρου τοῦ νομικοῦ προστάγματι καταγραφομένης’. (A later hand, Hand C, changed ‘καταγραφομένης’ in ‘μεταγραφομένης’).
In the middle of the upper margin of f. 2r there is an annotation in Tourrianos' hand, maybe an older shelf-mark (see Easterling 1961, p. 258), ‘n° 5’; the number was corrected by another hand, and it is not clear what was written below.
Provenance and Acquisition
Afterward, the manuscript was owned by a certain J.B. Hautin, probably to be identified with Jean Baptiste II Hautin, son of the French scholar and numismatist Jean-Baptiste Hautin (approximately b. 1580 d. 1640) (or possibly with his nephew Jean Baptiste III; on the problem of the identification of Hautin see Jackson 2006, pp. 38-40). The name of Hautin appears twice in the manuscript: on the left pastedown, ‘ J. B. Hautin ’, where it is accompanied by the title of the principal work, ‘Synopsis basilicon’, and on the right pastedown, ‘J. B. Hautin’). Hautin wrote in his hand a title for the manuscript on f. [ii] verso, ‘Synopsis basilicon’ (see Easterling 1961, p. 258).
John Moore (1646-1714) , bishop of Ely: no. 978 (left front cover) in the handwritten supplementary list of Moore's manuscripts, now MS CUL Oo.7.50(2), compiled by Thomas Tanner (1674-1735) after the publication of Bernard, Catalogi librorum manuscriptorum Angliæ et Hiberniæ (c. 1697).
Presented to the University Library in 1715 by George I (1660-1727) : donation bookplate engraved by John Pine (1690-1756) in 1736 on the left pastedown.
